Introduction
Playfly, LLC and its affiliates (“Playfly” or “Company” or “we” or “our”) respect your privacy and are committed to protecting it through our compliance with this policy.
This policy outlines the types of information we collect from you or that you provide when accessing the Playfly Platform, https://playfly.com/, as well as any related sites, mobile applications, software, and services (collectively, the “Playfly Platform”) that reference or link to this Privacy Policy. It further details our practices for collecting, using, maintaining, protecting, and disclosing that information.
This policy applies to information we collect:
- By your access or use of the Playfly Platform;
- Via our forms, applications, or other digital products you use; and
- From your interactions with our products and services, whether electronically or in-person.
It does not apply to information collected by any third party, including information collected on websites designed by the Company for the use of a third party, where information may be collected by parties outside of the control of the Company.
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Playfly Platform and not to utilize any of the services we provide on our platforms. By accessing or using the Playfly Platform or our services, you acknowledge that you have read, understood, and agree to this Privacy Policy. This policy may change from time to time (see “Changes to Our Privacy Policy” below). Your continued use of the Playfly Platform after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.
Children Under the Age of 13
The Playfly Platform is not intended for children under 13 years of age. No one under age 13 may provide any Personal Information to or on the Playfly Platform. We do not knowingly collect, use, or disclose Personal Information from children under 13 without verifiable parental consent. If you are under 13, do not use or provide any information on the Playfly Platform or provide any information about yourself to us through the other methods described above, including your name, address, telephone number, email address, or any screen name or user name you may use. If you are a parent or guardian and believe that your child under 13 has provided us with Personal Information without your consent, please contact us immediately at privacypolicy@playfly.com so that we can take appropriate action. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. In compliance with the U.S. Children’s Online Privacy Protection Act (COPPA), we will also notify parents or guardians as required. Information We Collect About You and How We Collect It
We collect several types of information from and about users of the Playfly Platform, including information:
- Personal Information: By which you may be personally identified, such as your name, email address, institutional affiliation (e.g., school or organization), and any other identifier by which you may be contacted online or offline (“Personal Information”);
- Technical Information: About your internet connection, device type, operating system, browser type, IP address, and other information related to the equipment you use to access the Playfly Platform or participate in Playfly events;
- Behavioral Information: Collected automatically, including usage details, browsing history, page interactions, and information collected through cookies, web beacons, or other tracking technologies;
- Publicly Available Information: From publicly accessible sources or as part of a lawful integration with social media or game platforms you use to participate in Playfly competitions; and
- Third-Party Information: Received from business partners, institutional affiliates (e.g., your school or team), game developers, or sponsors associated with Playfly events.
Information You Provide to Us
The information we collect on or through the Playfly Platform may include:
- Information Provided During Registration: Information that you provide by filling in forms on the Playfly Platform, including but not limited to, forms related to registrations, subscriptions services, and requests for additional service;
- Correspondence Records: Records and copies of your communications with us, including email addresses, phone numbers, or other contact information, when you reach out for inquiries or supports;
- Survey Responses: Your responses to surveys that we may ask you to complete for research or service improvement purposes;
- Payment or Financial Information: Details of transactions carried out through the Playfly Platform, including financial information required to complete purchases, such as credit card numbers or billing addresses, if applicable; and
- Search Queries and Usage Data: Details of searches or interactions you perform on the Playfly Platform.
Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with the Playfly Platform, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:
- Details of your visits to the Playfly Platform, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Playfly Platform; and
- Information about your computer and internet connection, including your IP address, operating system, and browser type.
We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). We do not respond to Do Not Track signals.
The information we collect automatically may include Personal Information or we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve the Playfly Platform and to deliver a better and more personalized service, including by enabling us to:
- Estimate our audience size and usage patterns;
- Store information about your preferences, allowing us to customize the Playfly Platform according to your individual interests;
- Speed up your searches; and
- Recognize you when you return to the Playfly Platform.
The technologies we use for this automatic data collection may include:
- Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. Cookies allow us to identify your preferences, remember session details, and enhance your browsing experience. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the Playfly Platform. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the Playfly Platform; and
- Web Beacons. Pages of the Playfly Platform and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) These allow us to track user interactions, count visitors to specific pages, determine the effectiveness of campaigns, and monitor system performance and server integrity.
We do not collect Personal Information automatically, but we may tie this information to Personal Information about you that we collect from other sources or you provide to us do not collect Personal Information automatically, but we may tie non-Personal Information collected automatically to Personal Information about you that we collect from other sources or that you provide to us.
The Playfly Platform may integrate with social media and other third-party platforms such as Discord, Twitch and OAuth. When you connect your account from a third-party platform to the Playfly Platform, then we may collect information from that third-party platform and share information with that third-party platform. This collected information may include, but is not limited to, your name, email address, demographic information from your profile, or other content. You acknowledge and agree that Playfly is not responsible for the data collection or use practices of any such connected third-party platform. You should read each third-party platform’s privacy policy before connecting that third-party account.
Third-Party Use of Cookies and Other Tracking Technologies
Some content or applications, including advertisements, on the Playfly Platform are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use the Playfly Platform. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. For information about how you can opt out of receiving targeted advertising from many providers, see “Choices About How We Use and Disclose Your Information” below.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any Personal Information:
- To operate, maintain, and improve the Playfly Platform and our online operations;
- To provide you with the products, services, or information you request;
- To communicate with you about your account, transactions, tournament updates, and other relevant activities;
- To process transactions, administer competitions, and provide customer support;
- To conduct research and analysis to improve and develop our products and services;
- To fulfill contractual obligations and enforce our rights, including billing and collection;
- To comply with legal obligations, ensure data security, and protect the integrity of our systems; and
- For any other purpose disclosed when you provide the information or with your consent.
Disclosure of Your Information
We may disclose aggregated information about our users and information that does not identify any individual without restriction, including for analytics, reporting, or service improvement purposes.
We may disclose Personal Information that we collect or you provide as described in this privacy policy:
- To our affiliates;
- To contractors, service providers, and other third parties we use to support our business;
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by the Company about the Playfly Platform users is among the assets transferred;
- To third parties, including sponsors, institutional partners, or advertisers, to market their products or services to you if you have consented to such disclosures or have not opted out. We contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them. For more information, see the section titled “Choices About How We Use and Disclose Your Information” below;
- To fulfill the purpose for which you provide it;
- For any other purpose disclosed by us when you provide the information; and
- With your consent.
We may also disclose your Personal Information:
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request; and
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others.
We may license third party software to include in or use with the Playfly Platform, in which case we may disclose Personal Information and/or Non-Personal Information to the licensor. These third parties’ collection and use of Personal Information and non-Personal Information are subject to their own privacy policies, which you can read here:
Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:
- Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly; and
- Promotional Offers from the Company. If you do not wish to have your email address, contact information, or gameplay preferences used by the Company to promote our own or third parties’ products or services, you can opt-out by adjusting your preferences in your account settings, checking the opt-out box on registration or data collection forms, or contacting us directly at privacypolicy@playfly.com. If we have sent you a promotional email, you can opt-out by clicking the “unsubscribe” link in the email or replying with a request to be omitted from future communications. Please note that this opt-out does not apply to information provided as part of Playfly tournament participation, product purchases, or other transactional communications.
We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s website here.
Residents of certain jurisdictions may have additional Personal Information rights and choices. Please see “Your Jurisdictional Privacy Rights” below for more information.
Accessing and Correcting Your Information
You can review and change your Personal Information by sending us an email at privacypolicy@playfly.com to request access to, correct or delete any Personal Information that you have provided to us. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
Residents of certain jurisdictions may have additional Personal Information rights and choices. Please see “Your Jurisdictional Privacy Rights” below for more information.
Your Jurisdictional Privacy Rights
Depending on your place of residence, you may have specific rights regarding your Personal Informaton under applicable data protection laws, as described in the following sections. You can exercise any of these rights by contacting us at: privacypolicy@playfly.com.
European Union
If you reside in a country in the European Economic Area or in Switzerland, then information we collect from you may be subject to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Information and on the free movement of such data, and repealing Directive 95/46/EC (the “GDPR”) and the following additional information is provided for your benefit. If you use the Playfly Platform, you acknowledge that your Personal Information is being processed pursuant to the following lawful bases: your consent, Playfly’s legitimate interests, the performance of a contract, and compliance with legal obligations. You further acknowledge and consent to your Personal Information being transferred to, stored in, and processed in the United States. As a data subject under the GDPR, you have the following rights to:
- Request a copy of the Personal Information we hold about you;
- Request that we correct any inaccurate or incomplete Personal Information;
- Request that we delete your Personal Information under certain conditions.
- Request that we limit the processing of your Personal Information.
- Request that we provide your Personal Information in a structured, commonly used, and machine-readable format;
- Object to the processing of your Personal Information in certain situations; and
- Lodge a complaint with a supervisory authority in the European Union, in particular in the Member State of your habitual residence, place of work, or place of the alleged infringement.
Canada
If you reside in Canada, your Personal Information is governed by applicable federal and provincial privacy laws, including the Personal Information Protection and Electronic Documents Act, and, where applicable, substantially similar provincial privacy laws. Your Personal Information may be transferred to or processed in jurisdictions outside of Canada, where it may be accessible to the courts, law enforcement, and national security authorities of those jurisdictions under applicable laws. As a Canadian resident, you have the right to:
- Access their Personal Information and obtain details on how it is being used or disclosed;
- Request corrections to inaccuracies in their Personal Information;
- Withdraw consent to the collection, use, or disclosure of their Personal Information, subject to legal or contractual restrictions;
- Be notified of security breaches involving their Personal Information if there is a risk of significant harm;
- Request the transfer of their Personal Information to another organization, where applicable under Quebec’s Bill 64; and
- Lodge a complaint with the Office of the Privacy Commissioner of Canada or a provincial privacy commissioner if a request is denied or not handled satisfactorily.
China
If you reside in the People’s Republic of China (excluding Hong Kong, Macau, and Taiwan), information we collect from you may be subject to the Personal Information Protection Law of the People’s Republic of China (the “PIPL”). By using the Playfly Platform, you acknowledge and consent to your Personal Information being transferred outside of mainland China to recipients who process data on our behalf, for the purposes and in the manner described in this Privacy Policy. We will retain your personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. As a data subject under the PIPL, you have the right to:
- Request access to your Personal Information;
- Request that we correct or complete any inaccurate or incomplete Personal Information;
- Request that we delete your Personal Information in certain circumstances; and
- Request that we provide an explanation of our processing rules.
Russia
If you reside in Russia, information we collect from you may be subject to Russian Federal Law No. 152-FZ, as amended. By using the Playfly Platform, you consent to the collection, use, and cross-border transfer of your Personal Information for the purposes and in the manner described in this Privacy Policy. As a data subject under Russian law, you have the right to:
- Request access to your Personal Information and receive information on how it is being processed;
- Request that we correct any of your inaccurate or incomplete Personal Information;
- Request that we delete your Personal Information, under certain circumstances; and
- Withdraw your consent at any time, subject to legal or contractual restrictions.
India
If you reside in India, information we collect from you may be subject to the Digital Personal Data Protection Act, 2023 (the “DPDPA”). By using the Playfly Platform, you acknowledge and consent to the collection, use, and processing of your Personal Information for the purposes described in this Privacy Policy, including the potential transfer of your Personal Information outside of India. As a data principal under the DPDPA, you have the right to:
- Request access to your Personal Information;
- Request correction or erasure of your Personal Information if it is inaccurate or no longer necessary for the purpose it was collected;
- Request the transfer of your Personal Information to another data fiduciary, where technically feasible and applicable; and
- Withdraw your consent to processing, where processing is based on consent.
Data Security
We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure.
The safety and security of your information also depends on you. Please do not provide unsolicited Personal Information in any field on the Playfly Platform, in email communications to the Company, or via other methods. We assume no risk or liability for protecting unsolicited information.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to the Playfly Platform. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Playfly Platform.
Changes to Our Privacy Policy
We will update this Privacy Policy as required by law or as our data practices evolve. When changes are made, we will post the updated policy on this page and revise the “Last Updated” date at the top of the policy. If changes materially affect how we collect, use, or disclose your Personal Information, we will provide a notice on the Playfly Platform home page, as required by applicable law. We encourage you to periodically review this page to stay informed about any updates to our privacy practices.
